Welcome to Banter, a chat platform designed to spark better conversations with the help of AI-generated prompts. By signing up or using Banter, you agree to these Terms of Service ("Terms") and our Privacy Policy.

1. Eligibility
You must be at least 13 years old to use Banter. If you are under 18, you must have permission from a parent or legal guardian.

2. Your Account
You must provide a valid name and email address to create an account. You are responsible for all activity under your account. Do not share your login credentials.

3. Acceptable Use
You agree not to:

• Use Banter to send spam, scams, or phishing attempts.
• Post or promote illegal, violent, or pornographic content.
• Harass or abuse other users.
• Use the platform to engage in unlawful behavior.

4. AI Prompts and Usage
Banter uses OpenAI’s API to generate AI prompts that appear within chats. The AI:

• Does not respond to your messages or act as a chatbot.
• Does process your messages to generate relevant prompts.
• Does not learn from your data — all data is ephemeral to OpenAI.

By using Banter, you consent to this use of your message data.

5. Data and Account Deletion
You can permanently delete your account at any time. Doing so will delete your personal information from our servers and revoke access to the app.

6. Paid Features & Payment Terms
We may offer optional paid services or subscriptions. Unless stated otherwise at checkout, all payments are non‑refundable and subscriptions renew automatically until you cancel. Detailed refund rules, billing cycles, and cancellation rights will be set out in our Payment Terms, which will be presented during purchase and accessible anytime in‑app.

7. Termination
We may suspend or terminate your account if you violate these Terms or misuse the platform, but—except in cases of imminent risk or legal mandate—we will give you reasonable notice (via email or in‑app) and an opportunity to appeal the decision within 14 days.

8. Changes
We may update these Terms at any time. We will notify users via email or in‑app notice at least 7 days in advance.

9. Disclaimer of Warranty
Banter is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the service will be uninterrupted, error‑free, or completely secure.

10. Limitation of Liability
To the maximum extent permitted by law, Banter and its affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, goodwill, data, or other intangible losses, resulting from your use of (or inability to use) the service—even if we have been advised of the possibility of such damages. Our total liability for all claims arising under these Terms will not exceed the greater of (a) the amount you paid Banter in the 12 months prior to the event giving rise to the claim or (b) $100.

11. Indemnification
You agree to indemnify, defend, and hold harmless Banter and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms or your misuse of the service.

12. Governing Law
These Terms are governed by the laws of the State of Delaware without regard to its conflict‑of‑laws principles. You agree to submit to the exclusive jurisdiction of the courts located in New Castle County, Delaware to resolve any dispute arising out of these Terms or the service.
